Can I Be Charged With DUI If I Am Not Driving?

The shocking answer to this question is yes you can.  If you have been drinking and are in your car with the keys in the ignition you can be charged with DUI. The key issue will be if you were in physical control of your vehicle. If you are unfortunate enough to have drank too much and realized it and decide to pull over and stop driving, you can still be charged with DUI. Regrettably in Florida, even if you do the right thing and stop driving you can still be charged with DUI. If you find yourself in this situation, call someone to come get you. Don't leave the car running. Take the keys out of the ignition. Move to the back seat of your car and wait for the person you called to come and get you. If you fall asleep and the police show up and investigate what you are doing, remember be polite and remember your rights. Don't give them a reason to initiate a DUI Investigation or other criminal investigation.
